The driver who hit Johnny Gaudreau said he drank 5-6 beers before the accident. In August, the Columbus forward and his brother were hit and killed by a car while riding their bikes.
Today, 43-year-old Sean Higgins, who was driving the SUV that hit the Gaudreau brothers, was indicted by a grand jury.
The driver, who was driving in the car in front of Higgins at the time of the accident, told police that he was driving aggressively. She said when she and the car in front of her slowed down and moved left to avoid the cyclists, Higgins accelerated and swerved to the right, hitting the Gaudreau brothers.
In police body camera footage, Higgins said he drank five or six beers starting around noon on the day of the accident.
I drank beer. “I haven’t had a drink for the last two hours, ” Higgins told police while standing on the side of the road.
Police say Higgins` blood alcohol level was 0. 087 ppm, which is above the legal limit of 0. 08 ppm. Additionally, Higgins failed a field sobriety test.
The police asked him to balance while standing on one leg and count out loud until he was told to stop. Higgins failed this test.

At the hearing, the defense argued that Higgins had recently undergone knee surgery, which could have affected the results of the sobriety test.
Later, after passing the test, the police handcuffed Higgins` hands and read him his rights. As he was led to the car, Higgins asked: Is everything okay there, what happened?
To which the police officer replied: We will talk about this at the station.
If convicted, Higgins faces up to 20 years in prison. He is scheduled to appear in court on January 7, 2025.
Gaudreau was the 2013 World Youth Champion with Team USA, a bronze medalist at the 2018 World Championships and an NCAA champion. Selected by Calgary in the fourth round of the 2011 NHL Entry Draft.
